Article 1. Applicability

1.1 These General Terms and Conditions apply to all offers, orders, and agreements made by Touched.Vintage.

1.2 By accepting an offer or placing an order, you agree to the applicability of these Terms and Conditions.

1.3 Any deviations from the provisions of these Terms and Conditions are only valid if agreed upon in writing, with all other provisions remaining in full force.

1.4 All rights and claims as stipulated in these Terms and Conditions and any further agreements made for the benefit of Touched.Vintage also apply for the benefit of intermediaries and other third parties engaged by Touched.Vintage.

Article 2. Offers / agreements

2.1 An agreement is only concluded after Touched.Vintage accepts your offer. Touched.Vintage reserves the right to refuse orders or impose specific conditions on delivery, unless otherwise explicitly stated. If an order is not accepted, Touched.Vintage will notify you within five (5) business days of receiving the order.

2.2 Offers from Touched Vintage are valid for 7 days. After this period, Touched Vintage reserves the right to reject any previously made offers.

Article 3. Prices and payments

3.1 All prices for products and services offered are quoted in euros. VAT is not charged on second-hand items. Import duties are the responsibility of the consumer.

3.2 Payment can be made via iDEAL, PayPal, or bank transfer. For payments via bank or giro transfer, the payment date is the date of crediting Touched.Vintage’s bank or giro account.

3.3 If the payment term is exceeded, Touched.Vintage reserves the right to decide whether the order will be canceled.

Article 4. Shipping / delivery

4.1 We offer worldwide shipping. Shipping within the Netherlands is free and fully insured. Shipping to European countries costs €29.50, fully insured. Shipping to non-European countries costs €39.50, fully insured.

4.2 We ship all items fully insured with PostNL, covering up to €5500. Once payment is received, we will ship your item within 24-48 hours.

4.3 Shipping to European countries typically takes 2-5 business days. Shipping to countries outside of Europe typically takes 5-10 business days. We are not responsible for delivery times.

4.4 Once your item is shipped, you will receive a tracking number to monitor the delivery status. Import duties, taxes, or any other costs associated with importing the purchased item are the customer’s responsibility. Always check your country’s import duties if outside the European Union.

4.5 If the item you ordered is unavailable, we will contact you the same day. Orders placed over the weekend will be shipped on Monday.

Article 5. Reservation of ownership

5.1 Ownership of the delivered products is transferred only once you have paid all amounts owed to Touched.Vintage under any agreement. Risk for the products passes to you at the time of delivery.

Article 6. Intellectual and industrial property rights

6.1 You must fully respect all intellectual and industrial property rights associated with the products delivered by Touched.Vintage.

6.2 Touched.Vintage does not guarantee that the products delivered do not infringe on any (unwritten) intellectual or industrial property rights of third parties.

Article 7. Returns / Right of Return

7.1 You have 14 days to return an item without providing a reason, starting from the date of receiving the item. Please note that all items from Touched.Vintage are second-hand and may show minor signs of wear.

7.2 All items are tagged, and if the tag is removed, the item cannot be returned.

7.3 If there is an issue with the item or if its condition does not match the description, please contact us immediately at info@touchedvintage.com and include your invoice number in the correspondence.

7.4 Items must be unused, returned with the tag still attached, and in their original packaging. If our return conditions are not met, we reserve the right to refuse the return.

7.5 Sale items are non-returnable.

7.6 Return shipping costs are the responsibility of the customer. For purchases outside the European Union, you must declare the return as a temporary import with no sales tax applied. The customs value should be marked as 0 Euro. If you declare the item as purchased, import duties will be your responsibility.

7.7 After cancellation of the agreement, the purchase amount will be refunded to your account within 14 days. The same payment method used for the original transaction will be applied for the refund.

7.9 If a customer sends a non-authentic item to Touched.Vintage for resale, Touched.Vintage has the right to charge the shipping costs to the provider.

Article 8. Guarantee for Authenticity

8.1 Touched.Vintage guarantees that the products delivered meet the usual standards and are free of defects.

8.2 If you have doubts about the authenticity of an item purchased from Touched.Vintage, please contact us. We can arrange for third-party authentication, with costs borne by the customer.

Article 9. Force Majeure

9.1 In case of force majeure, Touched.Vintage has the right to suspend the execution of your order or dissolve the agreement without judicial intervention by informing you in writing. Touched.Vintage will not be liable for any compensation, unless such a measure would be unreasonable under the circumstances.

9.2 Force majeure refers to any event beyond Touched.Vintage’s control, which prevents the fulfillment of the agreement and cannot be attributed to fault or negligence.

Article 10. Miscellaneous

10.1 If you provide Touched.Vintage with an address in writing, we are entitled to send all orders to that address, unless you notify us of a new address.

10.2 If Touched.Vintage allows deviations from these Terms and Conditions, whether tacitly or for a short or extended period, this does not affect our right to demand strict compliance with these Terms and Conditions in the future.

10.3 Touched.Vintage is authorized to use third parties in the execution of your order(s).

Article 11. Applicable Law and Competent Court

11.1 Dutch law exclusively governs all rights, obligations, offers, orders, and agreements to which these Terms and Conditions apply, as well as these Terms and Conditions themselves.

11.2 Any disputes will be submitted to the competent court in the Netherlands.

Article 12. Copyright

12.1 All images and content available on this website are protected by copyright. Reproduction, copying, or use of any part of the text or images without the express permission of the author is prohibited.
